I recently sold my house to a chinese lady,towards the end of the sale had loads of problems with the woman,so was just glad when the sale eventually went through,only problem was she ripped me off for £1000,i have been 3 months fighting with the soliciter to get this money back,a couple of weeks back the police raided my old house,it has been used as a cannabis farm,there was so much in there it took the police two and a half days to clear the house out,after this happened i thought i would now get my money back,how wrong could i be,the law is on her side and i still have to fight to get the money back...what a total joke..who does the law protect...

Well I enforce the law of this country and I can see exactly where you're coming from in all these things. Seems to me the law is skewed massively towards human rights above and beyond what common sense would dictate. I agree that human rights are necessary, but rather than being absolute, I feel certain human rights as per the provisions of the Human Rights Act 1998 should be conditional.

True, and the European legislators have much to answer for imo.
However, we stll have some way to go to catch up the US courts .. just consider the Stella Awards for 2010 (named after the woman who successfully sued MacDonalds after she spilled hot coffee on her lap whilst driving with the open container between her knees). Kathleen Robertson of Austin, Texas was awarded $80,000 by a jury of her peers after breaking her ankle tripping over a toddler who was running about inside a furniture store. The store owners were surprised by the verdict; the running toddler was her own son. Carl Truman, 19, of Los Angeles , California won $74,000 plus medical expenses when his neighbour ran over his hand with a Honda Accord. Apparently he didn't notice there was actually someone at the wheel of the car when he was trying to steal the hubcaps. Terrence Dickson, of Bristol , Pennsylvania , who whilst leaving via the garage of a house he had just burgled entering the house via its garage was trapped when the automatic door opener malfunctioned. He couldn't get back into the house either as the connecting door had locked when he pulled it shut. Forced to sit for eight days and survive on a case of Pepsi and a large bag of dry dog food, he successfully sued the homeowner's insurance company for $500,000, claiming undue mental anguish. Jerry Williams of Little Rock, Arkansas was awarded $14,500 plus medical expenses after being bitten on the ass by his next door neighbor's beagle .. even though the beagle was on a chain in its owner's fenced yard. He didn't get as much as he asked for because the jury believed the beagle "might have been provoked at the time because Williams had climbed over the fence into the yard and repeatedly shot the dog with a pellet gun. Amber Carson of Lancaster, Pennsylvania got a jury to order a restaurant to pay her $113,500 after she slipped on a puddle of soft drink and broke her coccyx. The drink was one she had thrown at her boyfriend 30 seconds earlier during an argument. Kara Walton of Claymont , Delaware sued the owner of a night club after she fell and knocked out her front teeth while trying to sneak through the ladies room window to avoid paying the $3.50 cover charge. She was awarded $12,000 plus dental expenses. But the best and runaway winner? Mrs. Merv Grazinski of Oklahoma City who bought a new 32-foot Winnebago. On her first trip on the freeway she set its cruise control and left the driver's seat to go to make herself a sandwich. After it left the freeway, crashed and overturned she sued Winnebago for not putting in the owner's manual that she couldn't safely leave the driver's seat while the cruise control was set and was awarded $1,750,000 plus a new motor home. CarylB - wow, some of those are truly absurd. You would think a decent defense lawyer would get those overturned in a minute. I work for Ford and heard about the Winnebago one at the time. I thought it was a joke at first! Now you get warnings with everything - sat nav, parking sensors, airbags etc etc. I'm sure in the UK the judge would have thrown most of them out of court and perhaps charged them with wasting police and court time... well, nearly sure ![]() |

Some of them I suspect are apochryphal .. but perhaps with a grain of truth; and some I think are true. I'd like to think we aren't there yet .. but who knows at what speed we will embrace the "sue them; it's not my responsibility culture"? And it's true that many of our judges are old and out of touch, their decisions (and in some cases their summing up) frequently gaga.
We have our share of odd cases .. In 1980, Lord Justice Ormrod, Lord Justice Dunn and Mr Justice Arnold ruled in the UK’s Court of Appeal that a wife from Basingstoke who rationed sex with her husband to once a week was behaving reasonably. Lord Hailsham later revealed that the ruling had provoked some newspapers to try to interview the wives of all the judges in the case. Cathy McGowan, 26, was overjoyed when a DJ on Radio Buxton told her that she had correctly answered a quiz question and had won the competition prize: a Renault Clio. Ecstasy collapsed into despair, however, when she arrived at the radio station and was presented with a 4-inch model of the car. In 2001, she sued and a judge at Derby County Court ruled that the now defunct station in Derbyshire had entered into a legally binding contract with Miss McGowan and ordered its owners to pay £8,000 for the real vehicle. A mother brought her sons ashes into court to prove he was dead after the DVLA continued to send letters addressed to her dead son two years after his death. Julie Strange, had sent her son's death certificate to the DVLA, but they issued a court summons. Ms Strange took her son's ashes into the court room and the prosecution was immediately dropped. A butcher appeared before a magistrates court after being accused of repeated breaches of a noise abatement order. Brian Clapton was told that he had to stop chopping meat between 6am to 8am after the council received complaints from a neighbour. Caryl |

Sorry to hear this, she sounds like a real cow if she knew all along that she was going to turn your old home into a cannibis farm, yet surly this would only of shown up since she moved in so why they seem to be branding you in the same category baffels me, the law is indeed an ass !! |

Thanks Emma,just the way things go im afraid,will be arguing out with the soliciters again this morning trying to get my momey back,but one consolation i am doing her for trespass as she entered the property the day before completion without permission and i am within my rights as it still belonged to me at the time,sounds petty but as things went missing as well,other than punch her face in ,not a lot more i can do,then i would just sink to her level and knowing my luck get locked up as well lol ,but believe me right now i really feel like it especially with everything else on top too

Sorry to hear about all of your troubles Barb. The petty thing about the trespassing might just get you somewhere. Al Capone, the notorious U.S gangster didn't go to jail for robbery or any of the bad crimes he commited. He went to jail for tax evasion! Hope it gets sorted out.
